By accessing or using AItocha ("Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old to create an account. Parents may use the Service to create AI models of their minor children, subject to our child safety policies.

2. Service Description

AItocha provides:

• AI model training from your uploaded photos
• AI-generated photos using your trained models
• Cloud storage for your photos and models
• Photo editing and enhancement tools

The Service uses artificial intelligence and results may vary. We do not guarantee specific outcomes or that generated images will match your expectations.

3. Account Responsibilities

• You are responsible for maintaining the security of your account
• You must provide accurate information when creating an account
• You may not share your account with others
• You must notify us immediately of any unauthorized access
• You are responsible for all activity under your account

4. Acceptable Use Policy

You agree NOT to use the Service to:

Violation of this policy will result in immediate account termination and may be reported to appropriate authorities.

5. Photo Ownership and Rights

5.1 Your Photos

You retain ownership of photos you upload. By uploading, you grant us a license to:

• Store and process your photos for AI training
• Create AI models based on your photos
• Generate new images using those models

5.2 Generated Images

You own the AI-generated images created using your trained models, subject to:

• Compliance with these Terms
• Our Acceptable Use Policy
• Applicable laws and third-party rights

5.3 Consent Requirements

You must have legal rights or consent to use any photos you upload. For photos of others, you must have their explicit permission. For photos of minors, you must be a parent or legal guardian.

6. Payments and Credits

• Credits are used to train models and generate images
• Purchased credits are non-refundable except as required by law
• We may change pricing at any time with 30 days notice
• Free credits may expire and cannot be transferred
• We process payments securely through Stripe

7. Termination

You may terminate: Delete your account at any time from Settings.

We may terminate or suspend your account:

• For violation of these Terms
• For illegal or harmful activity
• For extended inactivity (with notice)
• At our sole discretion with reasonable cause

Upon termination, your data will be deleted according to our Privacy Policy.

8. Disclaimers and Limitations

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
